These terms cover this website and every order placed through it. They are written in plain English wherever the law lets us write that way. They tell you what we owe you and what you owe us.
Agreeing to These Terms
Softscape Outdoor sells rubber mulch for playgrounds and landscape beds. We deliver it by the pallet to the 48 contiguous states. On this page, “we” and “us” mean Softscape Outdoor. “You” means the person or the organization placing the order.
Browsing softscapeoutdoor.com, placing an order, or paying for one means you accept these terms. If you do not accept them, do not order.
Three other pages are part of this agreement: our Delivery & Shipping terms, our Returns & Refunds policy, and our Privacy Policy. With this page, they are the whole agreement between us.
Who Can Order
You must be 18 or older to buy from us, and old enough to sign a contract where you live. Ordering tells us that is true, and that the details you gave us are correct and complete.
Ordering for a business, a school district, a parks department, or any other organization? Then you are telling us you have the authority to commit that organization to these terms.
What We Sell
We sell recycled rubber mulch by the pallet, in six colors. Each pallet holds 75 cubic feet. You choose the packaging: fifty bags of 1.5 cubic feet, or one super sack. A super sack comes off in one piece, so it needs a loading dock, or a forklift and a pallet jack. With no equipment on site, choose bags.
We work to describe the product accurately. Even so, we do not promise that every description, specification, or coverage figure on this site is complete, current, and free of error. Coverage depends on your depth and your site.
Color on a screen is not color in a yard. Monitors differ, lighting differs, and two batches of the same color can vary a little. What arrives can look different from the swatch you looked at.
Prices
Prices are in U.S. dollars. They cover delivery within the 48 contiguous states. We do not ship outside the United States or to U.S. territories.
The price you see includes the freight to your address. No shipping charge gets added later.
Prices, colors, and availability can change at any time, without notice.
If a price on the site turns out to be wrong, we can correct it, even after you have placed the order. We tell you first. Then you decide: pay the corrected price, or cancel and take your money back.
How Many Pallets You Can Order Online
Seven pallets is the limit for one online order. That is seven in total, counting every color in your cart together. Three pallets of one color and four of another is seven, and that is a full order.
Need more than seven? You have two routes:
- Place a second order of up to seven pallets, delivered the same way as the first.
- Ask us for a quote on a full truck. A truckload costs less per pallet. You need your own way to get the pallets off the truck.
Ask for a quote and we will price the mulch and the freight for your job.
When Your Order Becomes a Deal
Placing an order is an offer to buy. The deal is made when we accept the offer. An email telling you we received the order is not, by itself, acceptance.
We can decline, reduce, or cancel any order, including one already confirmed. Reasons include suspected fraud, a wrong price or description, a payment we cannot authorize, quantity limits, and an address no freight truck can reach. We can also cap how much one person, one household, or one order can buy, or ask for a quote instead of an online order.
If we cancel after your card has been charged, that money goes back to you under our Returns & Refunds policy.
Payment and Tax
You pay when you order. A third-party payment processor handles the card. It is PCI-DSS compliant, and full card numbers never sit on our servers. The processor has its own terms and privacy policy, and those apply to you too.
Placing an order authorizes us, and the processor, to verify your payment method and charge it for the order total. That total is the mulch, the freight, and any tax. You are also telling us the payment method is yours to use.
Sales tax, use tax, and similar taxes are yours to pay. We calculate what is due at checkout, based on where the order is going and the law that applies there. If no tax is collected at checkout, you may still owe use tax where you live.
Delivery
Orders ship by freight, on pallets. An online order of one to seven pallets comes off at the curb. Bags need no equipment at all. A super sack is the exception: it comes off in one piece, so it needs a loading dock, or a forklift and a pallet jack. A quoted truckload comes off with your own equipment. You unload that one, and you need a forklift or loader and a pallet jack ready on site.
Curbside means the curb, the end of the driveway, or the closest point the truck can safely reach. The driver sets the pallets down there. We deliver. We do not install, and we do not carry mulch into a yard or a play area. That part is yours or your contractor’s.
Any delivery date you see is an estimate, not a promise. The carrier calls to set the appointment, so keep the phone number on the order reachable and have someone there to receive the shipment.
Give us an address that is correct, complete, and reachable by a full-size freight truck. Ownership and risk pass to you once the order is delivered to the address you gave us.

All Sales Are Final
We do not take returns for a change of mind. Freight is why. Sending pallets back means a truck drives out to a home with no loading dock, loads them, and hauls them the whole way back. That bill can run as high as the mulch itself, and it would land on you. So we put the work in up front instead, and help you order the right amount the first time. Our calculator does that, and so does a phone call.
You can cancel or change an order any time before it leaves for delivery, and get the affected amount back in full. Once the freight is moving, the order cannot be canceled or turned around. After that, anything that happens to it on the road becomes a freight claim.
Where an order does not match what you purchased, Softscape Outdoor corrects it at its own expense.
Chargebacks
A change of mind does not justify a chargeback. Neither does refusing a delivery that showed up as described. When one lands on an order we delivered as described, we contest it, using the order file and the delivery records.
Installation, Depth, and Safety
Every color we sell is tested to ASTM F1292 and certified by IPEMA, an independent certification body. That test measures how a surface handles the impact of a fall under play equipment.
A test result comes from a tested depth. On your site, the protection depends on installing the mulch at the right depth, keeping it at that depth, and covering the whole fall zone. Depth follows the fall height of your equipment. Our playground safety guide has the depth table and the source it comes from.
Getting depth and fall-zone coverage right is your responsibility, along with the manufacturer’s instructions, the Consumer Product Safety Commission’s public playground safety handbook, and any local code that applies. We sell the mulch. We do not install it, and we do not inspect anyone’s surface. Nothing we publish, and nothing in these terms, is a promise that no one will be hurt. A certification records how the material performed in a test. It does not replace correct installation, regular depth checks, and supervision.
Warranties
Apart from what these terms say, and as far as the law allows, we sell the product “as is” and run this site “as available.” We disclaim every other warranty, whether express, implied, or created by statute. That includes the implied warranties of merchantability and non-infringement, and any implied warranty of fitness for a particular purpose.
Some states do not allow parts of that. Where your state does not, that part does not apply to you. You may also hold rights that vary from state to state.
Limits on Our Liability
As far as the law allows, Softscape Outdoor and our owners, officers, employees, and suppliers are not liable for indirect, incidental, or special damages. That covers consequential and punitive damages, lost profit, lost revenue, lost data, and harm to goodwill. It holds even if we were told such damage was possible.
Where the law lets us cap it, the most we can owe on any order is what you actually paid for the product behind the claim.
Some states do not allow limits like these. Where your state does not, they do not apply to you.
If You Cause a Claim Against Us
As far as the law allows, you will indemnify Softscape Outdoor and our owners, officers, employees, and suppliers, and hold them harmless, against claims, damages, costs, and reasonable attorney fees. This applies where those grow out of a breach of these terms by you, misuse of the product, or your breaking the law or someone else’s rights. Misuse includes poor installation, mulch spread too thin, and a fall zone left short.
Our Website and Its Content
The writing, photographs, graphics, guides, and the Softscape Outdoor name and logo belong to us or to those who license them to us. Copyright and trademark law protect them. Do not copy, republish, or distribute our content for commercial use without written permission from us.
Names such as IPEMA, ASTM, and CPSC belong to those organizations. We use them to identify a standard or a certification, nothing more.
Using the Site
Use this site for lawful purposes. Do not interfere with how it runs or how it is secured. Do not crawl it in a way that loads our systems. Do not place false or fraudulent orders. Do not use anything on it to infringe someone’s rights or break the law.
Links to Other Sites
We link out to sources, safety documents, and our payment processor. Those sites belong to other people. We do not control what they publish or how they operate, and a link from us is not an endorsement.
Things Outside Our Control
We are not liable for a delay or a failure caused by something we cannot reasonably control. That covers severe weather, flooding, wildfire, and other natural disasters. It also covers road and bridge closures, carrier and fuel disruption, supply problems, labor action, a public health emergency, and acts of government.
If We Disagree
We do not force you into binding arbitration. Nothing here takes away your right to bring a qualifying claim in small claims court, or to use the consumer protection laws of your own state. U.S. federal law and applicable state law govern these terms and your purchase.

When These Terms Change
We update these terms now and then. When we do, the date at the top of this page changes. A change applies going forward, from the day it is posted. The terms that were live on the day you ordered are the terms for that order. Using the site after a change means you accept the updated version.
The Rest of the Fine Print
If a court finds one part of these terms unenforceable, the other parts still stand. If we do not enforce a term right away, we have not given up the right to enforce it later. You cannot transfer these terms to anyone else without our written consent. We can transfer them if the business merges, is acquired, or sells its assets. This page and the policies it points to are the complete agreement on their subject. We can change, pause, or drop any part of the site or the product line at any time and without notice. We owe you nothing for doing so.
